Ondrovic & Platek was again successful in obtaining a ruling from the Honorable Peter Sweeney during a trial which recently took place at the Kings County Supreme Court which allowed the Defendants to question Plaintiff’s treating physician regarding fraud allegations made against him in a federal court RICO complaint.
Jeremy Platek, Esq. urged the Court to apply Court of Appeals caselaw in the matter of People v. Smith, which allowed police officers to be questioned regarding allegations made against them in a Civilian Complaint Review Board proceeding, to a civil action on the basis that the precedent established by the Court of Appeals should be applied to allow Defendant to question a witness who it was alleged committed bad acts.
Ultimately, the matter of Joaquin Moreno v. 105 Lombardy NY, LLC, et al., Kings Co. Index No. 514509/2019 [7/22/26]) where plaintiff had obtained summary judgment and was represented by the Elefterakis firm, settled for a very reasonable, and confidential, number.
